Farvion telah resmi rilis. Kami terus mengembangkan dan menyempurnakan layanan ini, sehingga fitur dapat berubah dari waktu ke waktu dan layanan dapat sesekali mengalami gangguan. Dengan menggunakan Farvion, Anda memahami dan menerima kondisi ini.

1. Penerimaan syarat

Dengan mengakses atau menggunakan Farvion, Anda setuju untuk terikat oleh Syarat & Ketentuan ini. Jika Anda tidak setuju dengan salah satu ketentuan di sini, mohon untuk tidak menggunakan Farvion.

2. Tentang layanan ini

Farvion adalah aplikasi asisten percakapan berbasis AI yang dikembangkan oleh tim Farvion, dipimpin oleh Pinzz sebagai founder ("kami", "pengembang"). Farvion saat ini berstatus rilis resmi publik dan disediakan "sebagaimana adanya" (as-is) tanpa jaminan ketersediaan, keakuratan, atau kinerja tertentu.

3. Batasan usia

Farvion ditujukan untuk pengguna berusia 13 tahun ke atas. Jika Anda berusia di bawah usia mayoritas hukum di wilayah Anda (misalnya di bawah 18 tahun di banyak wilayah), Anda memerlukan persetujuan dan pengawasan dari orang tua atau wali sebelum menggunakan Farvion.

4. Akun Anda

Anda masuk ke Farvion menggunakan akun Google. Anda bertanggung jawab menjaga keamanan akses ke akun Google Anda.
Anda bertanggung jawab atas semua aktivitas yang terjadi melalui akun Farvion Anda.
Anda dapat menghapus akun Anda kapan saja melalui menu Akun di dalam aplikasi. Penghapusan akun bersifat permanen.

5. Kunci API milik Anda (BYOK)

Farvion menggunakan model "bawa kunci API Anda sendiri" (BYOK) untuk mengakses model AI. Ini berarti:

Anda bertanggung jawab penuh atas kunci API yang Anda masukkan, termasuk biaya penggunaan yang timbul dari penyedia model AI terkait sesuai kebijakan mereka sendiri.
Anda bertanggung jawab menjaga kerahasiaan kunci API Anda. Kunci API disimpan secara lokal di perangkat/peramban Anda, dan hanya dikirim ke server kami saat diperlukan untuk memproses permintaan Anda.
Kami tidak bertanggung jawab atas biaya, pembatasan, atau masalah apa pun yang timbul dari kunci API yang Anda gunakan.

6. Penggunaan yang wajar

Anda setuju untuk tidak menggunakan Farvion untuk:

Melanggar hukum yang berlaku di wilayah Anda.
Menghasilkan atau menyebarkan konten yang melanggar hukum, berbahaya, atau melanggar hak pihak lain (termasuk hak cipta dan privasi).
Mencoba mengeksploitasi, meretas, atau mengganggu jalannya layanan Farvion atau infrastruktur pendukungnya.
Menyalahgunakan Farvion untuk aktivitas yang membahayakan diri sendiri atau orang lain.

Kami berhak menangguhkan atau menghapus akun yang melanggar ketentuan penggunaan wajar ini.

7. Moderasi konten otomatis dan sistem strike

Untuk menegakkan ketentuan penggunaan wajar pada bagian 6, pesan yang Anda kirim ke Farvion diperiksa secara otomatis oleh sistem klasifikasi berbasis AI setelah balasan diberikan kepada Anda. Sistem ini mendeteksi kategori seperti permintaan konten berbahaya (mis. malware, senjata/bahan berbahaya, penipuan/phishing), ancaman kekerasan, ujaran kebencian, konten yang mengeksploitasi anak, indikasi self-harm pada diri Anda sendiri, dan percobaan melewati batasan sistem (jailbreak).

Konsekuensi terhadap akun Anda berbeda-beda tergantung kategori pelanggaran:

Pelanggaran umum (malware, penipuan, ancaman kekerasan, ujaran kebencian, dan sejenisnya): dicatat sebagai "strike". Tiga strike dalam periode 30 hari akan menyebabkan akun Anda ditangguhkan secara otomatis; satu pelanggaran yang tergolong sangat serius dapat langsung menyebabkan penangguhan tanpa menunggu strike ketiga.
Konten yang mengeksploitasi anak (CSAM/grooming): menyebabkan akun langsung diblokir permanen secara otomatis, tanpa melalui sistem strike, mengingat tingkat keseriusannya.
Percobaan jailbreak yang berulang dalam waktu singkat dapat menyebabkan penangguhan sementara (bukan permanen).
Indikasi self-harm pada diri Anda sendiri tidak pernah ditindak sebagai pelanggaran dan tidak akan menyebabkan penangguhan atau pemblokiran akun; ini semata-mata dicatat untuk keperluan dukungan, bukan penegakan aturan.

Klasifikasi otomatis ini dapat keliru. Jika Anda merasa akun Anda ditangguhkan secara tidak tepat, Anda dapat mengajukan banding melalui kanal kontak pada bagian 17; tim kami akan meninjau kasus tersebut secara manual dan dapat mencabut penangguhan apabila terbukti merupakan false positive. Lihat juga Kebijakan Privasi kami untuk penjelasan mengenai data apa saja yang dicatat dalam proses ini.

8. Konten yang Anda kirim

Anda tetap memiliki hak atas konten (teks, gambar, file) yang Anda kirim ke Farvion. Dengan mengirimkan konten tersebut, Anda memberi kami izin terbatas untuk memproses dan menyimpan konten itu semata-mata untuk menjalankan fungsi layanan (misalnya menampilkan riwayat percakapan Anda dan meneruskannya ke model AI untuk menghasilkan balasan). Anda menyatakan bahwa Anda memiliki hak yang diperlukan atas konten yang Anda kirim dan bahwa konten tersebut tidak melanggar hak pihak lain. Lihat Kebijakan Privasi kami untuk detail lebih lanjut.

9. Pembuatan dan pengeditan gambar

Farvion dapat membuat gambar baru dari deskripsi teks (prompt) Anda dan mengedit gambar yang Anda unggah. Dengan menggunakan fitur ini, Anda memahami dan menyetujui hal-hal berikut:

Kuota harian: pembuatan dan pengeditan gambar dibatasi oleh kuota harian per akun yang berbeda menurut tier (Free atau Pro). Membuat gambar dan mengedit gambar berbagi satu kuota yang sama. Kuota dapat berubah dari waktu ke waktu, dan kami dapat membatasi atau menonaktifkan sementara fitur ini bila diperlukan untuk menjaga stabilitas layanan.
Gambar yang Anda unggah: hanya unggah gambar yang Anda berhak gunakan. Anda menyatakan bahwa Anda memiliki hak atas gambar tersebut dan, apabila gambar memuat orang lain, telah memperoleh izin yang diperlukan.
Larangan penggunaan: selain ketentuan pada bagian 6, Anda dilarang menggunakan fitur ini untuk membuat atau mengedit gambar yang (a) mengandung eksploitasi atau seksualisasi anak; (b) bersifat seksual atau telanjang tanpa persetujuan orang yang digambarkan; (c) meniru atau memalsukan orang nyata (misalnya deepfake) untuk menipu, mencemarkan nama baik, atau melecehkan; (d) memuat kekerasan ekstrem, ujaran kebencian, atau menghasut kekerasan; atau (e) melanggar hak cipta, merek dagang, atau hak pihak lain.
Moderasi: permintaan Anda untuk membuat atau mengedit gambar diperlakukan seperti pesan lainnya dan dapat tunduk pada sistem moderasi otomatis dan strike pada bagian 7. Kami juga dapat menolak permintaan gambar tertentu.
Hasil tidak dijamin: gambar dibuat secara otomatis oleh model AI sehingga dapat tidak akurat, janggal, tidak sesuai permintaan, atau kebetulan menyerupai karya pihak lain. Pada pengeditan, gambar yang Anda unggah dapat diperkecil ukurannya sehingga resolusi hasil bisa lebih rendah daripada aslinya.
Penggunaan hasil dan tanggung jawab: sepanjang diizinkan oleh hukum yang berlaku dan tanpa mengurangi hak pihak lain, Anda dapat menggunakan gambar hasil Farvion untuk keperluan Anda. Kami tidak menjamin bahwa hasil tersebut dapat dilindungi hak cipta atau bebas dari klaim pihak lain. Anda bertanggung jawab penuh atas cara Anda menggunakan, membagikan, atau menerbitkan gambar tersebut, termasuk untuk keperluan komersial.
Penyimpanan terbatas: gambar hasil buatan disimpan di akun Anda dalam jumlah terbatas sesuai tier. Gambar yang paling lama dapat dihapus otomatis untuk memberi ruang bagi gambar baru, jadi unduh dan simpan sendiri gambar yang penting bagi Anda.

10. Hak kekayaan intelektual

Nama "Farvion", logo, tampilan antarmuka, dan kode sumber layanan ini adalah milik tim pengembang Farvion (dipimpin oleh Pinzz) dan dilindungi oleh hukum hak cipta serta kekayaan intelektual yang berlaku. Anda tidak diperkenankan menyalin, memodifikasi, mendistribusikan ulang, merekayasa balik (reverse engineer), atau menggunakan aset visual maupun kode Farvion untuk tujuan komersial tanpa izin tertulis dari kami, kecuali sepanjang diizinkan secara eksplisit (misalnya melalui lisensi sumber terbuka jika berlaku pada bagian tertentu dari proyek ini).

11. Keterbatasan tanggung jawab AI

Balasan yang dihasilkan Farvion berasal dari model AI dan dapat mengandung kesalahan, ketidakakuratan, atau informasi yang sudah usang. Jangan mengandalkan balasan Farvion sebagai satu-satunya sumber untuk keputusan penting (misalnya medis, hukum, atau finansial) tanpa verifikasi lebih lanjut dari sumber yang kredibel. Lihat juga halaman Disclaimer kami untuk informasi lebih lengkap.

12. Penangguhan dan penghentian akun

Kami berhak menangguhkan atau menghentikan akses Anda ke Farvion, dengan atau tanpa pemberitahuan sebelumnya, jika kami menemukan indikasi Anda melanggar Syarat & Ketentuan ini (termasuk lewat sistem moderasi otomatis pada bagian 7), menyalahgunakan layanan, atau membahayakan keamanan/integritas layanan bagi pengguna lain. Anda juga dapat menghentikan penggunaan Farvion dan menghapus akun Anda kapan saja melalui menu Akun. Ketentuan pada bagian 8 (Konten yang Anda kirim), 9 (Pembuatan dan pengeditan gambar), 10 (Hak kekayaan intelektual), 11 (Keterbatasan tanggung jawab AI), 13 (Batasan tanggung jawab), dan 15 (Hukum yang berlaku) tetap berlaku setelah akun dihentikan atau dihapus.

13. Perubahan dan ketersediaan layanan

Karena Farvion masih dalam tahap pengembangan, kami dapat menambah, mengubah, atau menghentikan fitur tertentu, mengalami waktu henti (downtime), atau mengubah Syarat & Ketentuan ini dari waktu ke waktu. Kami akan berupaya memberi tahu jika ada perubahan besar, namun tidak menjamin pemberitahuan untuk setiap perubahan kecil selama masa pengembangan. Kami juga tidak bertanggung jawab atas keterlambatan atau kegagalan menjalankan layanan yang disebabkan oleh keadaan di luar kendali wajar kami (force majeure), termasuk namun tidak terbatas pada gangguan pada penyedia infrastruktur pihak ketiga, bencana alam, atau gangguan jaringan internet.

14. Batasan tanggung jawab dan ganti rugi

Sepanjang diizinkan oleh hukum yang berlaku, Farvion disediakan "sebagaimana adanya" tanpa jaminan apa pun. Kami tidak bertanggung jawab atas kerugian tidak langsung, kehilangan data, atau kerugian lain yang timbul dari penggunaan layanan ini. Anda setuju untuk membebaskan dan tidak meminta pertanggungjawaban kami atas tuntutan pihak ketiga yang timbul dari pelanggaran Anda terhadap Syarat & Ketentuan ini atau penyalahgunaan layanan oleh Anda.

15. Hukum yang berlaku dan penyelesaian sengketa

Syarat & Ketentuan ini tunduk pada dan ditafsirkan sesuai dengan hukum Republik Indonesia, tanpa memperhatikan pertentangan aturan hukum. Setiap sengketa yang timbul dari atau terkait dengan Syarat & Ketentuan ini akan diupayakan penyelesaiannya terlebih dahulu secara musyawarah antara Anda dan kami. Apabila musyawarah tidak berhasil, sengketa akan diselesaikan melalui pengadilan yang berwenang di Indonesia, kecuali diatur lain oleh hukum yang berlaku.

16. Ketentuan lain-lain

Jika ada satu ketentuan dalam Syarat & Ketentuan ini yang dinyatakan tidak sah atau tidak dapat diberlakukan oleh pengadilan yang berwenang, ketentuan tersebut akan dipisahkan dan tidak memengaruhi keberlakuan ketentuan lainnya. Kegagalan kami untuk menegakkan suatu hak atau ketentuan tidak dianggap sebagai pelepasan hak atas ketentuan tersebut.

Terms of Service

Farvion has officially launched. We continue to develop and improve the service, so features may change over time and occasional interruptions may occur. By using Farvion, you understand and accept these conditions.

1. Acceptance of terms

By accessing or using Farvion, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use Farvion.

2. About this service

Farvion is an AI-powered conversational assistant developed by the Farvion team, founded and led by Pinzz ("we", "the developer"). Farvion is currently in official public release and is provided "as-is" without any guarantee of specific availability, accuracy, or performance.

3. Age restrictions

Farvion is intended for users aged 13 and older. If you are under the age of legal majority in your region (e.g. under 18 in many jurisdictions), you need consent and supervision from a parent or guardian before using Farvion.

4. Your account

You sign in to Farvion using a Google account. You are responsible for keeping access to your Google account secure.
You are responsible for all activity that occurs through your Farvion account.
You may delete your account at any time from the Account menu within the app. Account deletion is permanent.

5. Your own API key (BYOK)

Farvion uses a "bring your own API key" (BYOK) model to access AI models. This means:

You are fully responsible for the API key(s) you enter, including any usage costs incurred with the relevant AI model provider under their own policies.
You are responsible for keeping your API key confidential. Your API key is stored locally on your device/browser, and is only sent to our server when needed to process your request.
We are not responsible for any costs, restrictions, or issues arising from the API key(s) you use.

6. Acceptable use

You agree not to use Farvion to:

Violate any law applicable in your region.
Generate or distribute content that is illegal, harmful, or infringes on others' rights (including copyright and privacy).
Attempt to exploit, hack, or disrupt Farvion's operation or its supporting infrastructure.
Misuse Farvion for activity that endangers yourself or others.

We reserve the right to suspend or remove accounts that violate this acceptable use policy.

7. Automated content moderation and strike system

To enforce the acceptable use policy in section 6, messages you send to Farvion are automatically screened by an AI-based classification system after a reply has already been given to you. This system detects categories such as requests for harmful content (e.g. malware, weapons/hazardous materials, fraud/phishing), threats of violence, hate speech, content that exploits children, indications of self-harm affecting you personally, and attempts to bypass system restrictions (jailbreaking).

The consequences for your account differ depending on the category of violation:

General violations (malware, fraud, threats of violence, hate speech, and similar): recorded as a "strike". Three strikes within a 30-day period will result in your account being automatically suspended; a single violation deemed very serious can result in immediate suspension without waiting for a third strike.
Content that exploits children (CSAM/grooming): results in the account being immediately and automatically banned permanently, bypassing the strike system entirely, given the severity involved.
Repeated jailbreak attempts within a short period of time can result in a temporary (not permanent) suspension.
Indications of self-harm affecting you personally are never treated as a violation and will never result in suspension or a ban; this is logged solely for support purposes, not rule enforcement.

This automated classification can be wrong. If you believe your account was suspended incorrectly, you may appeal through the contact channel in section 17; our team will manually review the case and may lift the suspension if it is found to be a false positive. See also our Privacy Policy for an explanation of what data is logged in this process.

8. Content you submit

You retain ownership of the content (text, images, files) you send to Farvion. By submitting that content, you grant us a limited license to process and store it solely to run the service's functionality (e.g. displaying your conversation history and relaying it to the AI model to generate a reply). You represent that you hold the necessary rights to the content you submit and that it does not infringe on the rights of others. See our Privacy Policy for further details.

9. Image generation and editing

Farvion can create new images from your text description (prompt) and edit images you upload. By using this feature, you understand and agree to the following:

Daily quota: image generation and editing are limited by a daily per-account quota that differs by tier (Free or Pro). Generating images and editing images share the same quota. Quotas may change from time to time, and we may temporarily limit or disable this feature when needed to keep the service stable.
Images you upload: only upload images you have the right to use. You represent that you hold the rights to those images and, if an image contains other people, that you have obtained any necessary permission.
Prohibited use: in addition to section 6, you must not use this feature to create or edit images that (a) involve the exploitation or sexualization of children; (b) are sexual or nude without the consent of the person depicted; (c) imitate or falsify real people (e.g. deepfakes) to deceive, defame, or harass; (d) contain extreme violence, hate speech, or incitement to violence; or (e) infringe copyright, trademarks, or the rights of others.
Moderation: your requests to generate or edit images are treated like any other message and may be subject to the automated moderation and strike system in section 7. We may also decline certain image requests.
No guarantee of results: images are generated automatically by an AI model and may be inaccurate, odd, different from what you asked for, or coincidentally resemble someone else's work. When editing, the image you upload may be downscaled, so the result can have a lower resolution than the original.
Use of results and responsibility: to the extent permitted by applicable law and without limiting the rights of others, you may use images produced by Farvion for your own purposes. We do not guarantee that such results can be protected by copyright or are free from third-party claims. You are fully responsible for how you use, share, or publish those images, including for commercial purposes.
Limited storage: generated images are kept in your account in a limited number depending on your tier. The oldest images may be deleted automatically to make room for new ones, so download and keep your own copy of any image that matters to you.

10. Intellectual property

The "Farvion" name, logo, interface design, and source code of this service belong to the Farvion development team (founded and led by Pinzz) and are protected by applicable copyright and intellectual property laws. You may not copy, modify, redistribute, reverse engineer, or use Farvion's visual assets or code for commercial purposes without our written permission, except to the extent explicitly permitted (for example, under an open-source license if applicable to specific parts of this project).

11. AI limitations of liability

Replies generated by Farvion come from an AI model and may contain errors, inaccuracies, or outdated information. Do not rely on Farvion's replies as the sole source for important decisions (e.g. medical, legal, or financial) without further verification from a credible source. See also our Disclaimer page for more complete information.

12. Suspension and termination

We reserve the right to suspend or terminate your access to Farvion, with or without prior notice, if we find indications that you have violated these Terms of Service (including via the automated moderation system in section 7), misused the service, or endangered the security or integrity of the service for other users. You may also stop using Farvion and delete your account at any time from the Account menu. Sections 8 (Content you submit), 9 (Image generation and editing), 10 (Intellectual property), 11 (AI limitations of liability), 13 (Limitation of liability), and 15 (Governing law) survive termination or deletion of your account.

13. Changes and service availability

Because Farvion is still under development, we may add, change, or discontinue certain features, experience downtime, or update these Terms of Service from time to time. We will try to notify you of major changes, but do not guarantee notice for every minor change during the development period. We are also not liable for delays or failures in performing the service caused by circumstances reasonably beyond our control (force majeure), including but not limited to disruptions at third-party infrastructure providers, natural disasters, or internet network outages.

14. Limitation of liability and indemnification

To the extent permitted by applicable law, Farvion is provided "as-is" without any warranties. We are not liable for indirect losses, data loss, or other damages arising from the use of this service. You agree to hold us harmless from and against any third-party claims arising from your violation of these Terms of Service or your misuse of the service.

15. Governing law and dispute resolution

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms of Service will first be attempted to be resolved amicably between you and us. If amicable resolution is unsuccessful, the dispute will be settled through the competent courts in Indonesia, unless otherwise provided by applicable law.

16. Miscellaneous

If any provision of these Terms of Service is found invalid or unenforceable by a court of competent jurisdiction, that provision will be severed and will not affect the enforceability of the remaining provisions. Our failure to enforce any right or provision will not be considered a waiver of that right or provision.

Farvion se ha lanzado oficialmente. Seguimos desarrollando y mejorando el servicio, por lo que las funciones pueden cambiar con el tiempo y pueden ocurrir interrupciones ocasionales. Al usar Farvion, comprendes y aceptas estas condiciones.

1. Aceptación de los términos

Al acceder o usar Farvion, aceptas quedar vinculado por estos Términos de Servicio. Si no estás de acuerdo con alguna parte de estos términos, por favor no uses Farvion.

2. Sobre este servicio

Farvion es un asistente conversacional basado en IA, desarrollado por el equipo de Farvion, fundado y liderado por Pinzz ("nosotros", "el desarrollador"). Farvion se encuentra actualmente en lanzamiento público oficial y se ofrece "tal cual" (as-is), sin ninguna garantía de disponibilidad, precisión o rendimiento específicos.

3. Restricciones de edad

Farvion está destinado a usuarios de 13 años o más. Si tienes menos de la edad de mayoría legal en tu región (por ejemplo, menos de 18 años en muchas jurisdicciones), necesitas el consentimiento y la supervisión de un padre, madre o tutor antes de usar Farvion.

4. Tu cuenta

Inicias sesión en Farvion usando una cuenta de Google. Eres responsable de mantener segura el acceso a tu cuenta de Google.
Eres responsable de toda la actividad que ocurra a través de tu cuenta de Farvion.
Puedes eliminar tu cuenta en cualquier momento desde el menú de Cuenta dentro de la aplicación. La eliminación de la cuenta es permanente.

5. Tu propia clave de API (BYOK)

Farvion utiliza un modelo de "trae tu propia clave de API" (BYOK) para acceder a los modelos de IA. Esto significa que:

Eres totalmente responsable de la(s) clave(s) de API que introduzcas, incluyendo los costos de uso que se generen con el proveedor del modelo de IA correspondiente conforme a sus propias políticas.
Eres responsable de mantener la confidencialidad de tu clave de API. Tu clave de API se almacena localmente en tu dispositivo/navegador, y solo se envía a nuestro servidor cuando es necesario para procesar tu solicitud.
No somos responsables de ningún costo, restricción o problema derivado de la(s) clave(s) de API que uses.

6. Uso aceptable

Aceptas no usar Farvion para:

Infringir cualquier ley aplicable en tu región.
Generar o distribuir contenido ilegal, dañino o que infrinja los derechos de terceros (incluyendo derechos de autor y privacidad).
Intentar explotar, hackear o interrumpir el funcionamiento de Farvion o su infraestructura de soporte.
Usar Farvion de forma indebida para actividades que pongan en peligro a ti mismo o a otras personas.

Nos reservamos el derecho de suspender o eliminar cuentas que infrinjan esta política de uso aceptable.

7. Moderación de contenido automática y sistema de strikes

Para hacer cumplir la política de uso aceptable de la sección 6, los mensajes que envías a Farvion se analizan automáticamente mediante un sistema de clasificación basado en IA, después de que ya se te haya dado una respuesta. Este sistema detecta categorías como solicitudes de contenido dañino (p. ej. malware, armas/materiales peligrosos, fraude/phishing), amenazas de violencia, discurso de odio, contenido que explota a menores, indicios de autolesión que te afecten a ti, e intentos de eludir las restricciones del sistema (jailbreak).

Las consecuencias para tu cuenta varían según la categoría de la infracción:

Infracciones generales (malware, fraude, amenazas de violencia, discurso de odio y similares): se registran como un "strike" (aviso). Tres strikes en un período de 30 días provocarán la suspensión automática de tu cuenta; una sola infracción considerada muy grave puede provocar la suspensión inmediata sin esperar a un tercer strike.
Contenido que explota a menores (CSAM/grooming): provoca el bloqueo inmediato, automático y permanente de la cuenta, sin pasar por el sistema de strikes, dada la gravedad del caso.
Los intentos repetidos de jailbreak en un período corto pueden provocar una suspensión temporal (no permanente).
Los indicios de autolesión que te afecten a ti nunca se tratan como una infracción y nunca provocarán una suspensión o un bloqueo; esto se registra únicamente con fines de apoyo, no para hacer cumplir normas.

Esta clasificación automática puede equivocarse. Si consideras que tu cuenta fue suspendida incorrectamente, puedes apelar a través del canal de contacto de la sección 17; nuestro equipo revisará el caso manualmente y podrá levantar la suspensión si se determina que fue un falso positivo. 8. Contenido que envías

Conservas la propiedad del contenido (texto, imágenes, archivos) que envías a Farvion. Al enviar ese contenido, nos otorgas una licencia limitada para procesarlo y almacenarlo únicamente con el fin de ejecutar la funcionalidad del servicio (por ejemplo, mostrar tu historial de conversaciones y transmitirlo al modelo de IA para generar una respuesta). Declaras que posees los derechos necesarios sobre el contenido que envías y que dicho contenido no infringe los derechos de terceros. Consulta nuestra Política de Privacidad para más detalles.

9. Generación y edición de imágenes

Farvion puede crear imágenes nuevas a partir de tu descripción de texto (prompt) y editar imágenes que subas. Al usar esta función, comprendes y aceptas lo siguiente:

Cuota diaria: la generación y edición de imágenes están limitadas por una cuota diaria por cuenta que varía según el nivel (Free o Pro). Generar imágenes y editar imágenes comparten la misma cuota. Las cuotas pueden cambiar con el tiempo y podemos limitar o desactivar temporalmente esta función cuando sea necesario para mantener la estabilidad del servicio.
Imágenes que subes: sube solo imágenes que tengas derecho a usar. Declaras que tienes los derechos sobre esas imágenes y, si contienen a otras personas, que has obtenido los permisos necesarios.
Usos prohibidos: además de lo dispuesto en la sección 6, no debes usar esta función para crear o editar imágenes que (a) impliquen la explotación o sexualización de menores; (b) sean sexuales o de desnudos sin el consentimiento de la persona representada; (c) imiten o falsifiquen a personas reales (por ejemplo, deepfakes) para engañar, difamar o acosar; (d) contengan violencia extrema, discurso de odio o incitación a la violencia; o (e) infrinjan derechos de autor, marcas u otros derechos de terceros.
Moderación: tus solicitudes para generar o editar imágenes se tratan como cualquier otro mensaje y pueden estar sujetas al sistema de moderación automática y strikes de la sección 7. También podemos rechazar ciertas solicitudes de imágenes.
Sin garantía de resultados: las imágenes las genera automáticamente un modelo de IA y pueden ser inexactas, extrañas, distintas de lo que pediste o parecerse por casualidad a la obra de otra persona. Al editar, la imagen que subes puede reducirse de tamaño, por lo que el resultado puede tener menor resolución que el original.
Uso de los resultados y responsabilidad: en la medida permitida por la ley aplicable y sin limitar los derechos de terceros, puedes usar las imágenes producidas por Farvion para tus propios fines. No garantizamos que dichos resultados puedan protegerse por derechos de autor ni que estén libres de reclamaciones de terceros. Eres plenamente responsable de cómo usas, compartes o publicas esas imágenes, incluso con fines comerciales.
Almacenamiento limitado: las imágenes generadas se conservan en tu cuenta en un número limitado según tu nivel. Las más antiguas pueden eliminarse automáticamente para dejar espacio a las nuevas, así que descarga y conserva tu propia copia de las imágenes importantes.

10. Propiedad intelectual

El nombre "Farvion", el logotipo, el diseño de la interfaz y el código fuente de este servicio pertenecen al equipo de desarrollo de Farvion (fundado y liderado por Pinzz) y están protegidos por las leyes de derechos de autor y propiedad intelectual aplicables. No podrás copiar, modificar, redistribuir, aplicar ingeniería inversa ni usar los recursos visuales o el código de Farvion con fines comerciales sin nuestro permiso por escrito, salvo en la medida en que esté explícitamente permitido (por ejemplo, mediante una licencia de código abierto si aplica a partes específicas de este proyecto).

11. Limitaciones de responsabilidad de la IA

Las respuestas generadas por Farvion provienen de un modelo de IA y pueden contener errores, imprecisiones o información desactualizada. No confíes en las respuestas de Farvion como única fuente para decisiones importantes (por ejemplo, médicas, legales o financieras) sin verificación adicional de una fuente confiable. 12. Suspensión y cancelación de cuenta

Nos reservamos el derecho de suspender o cancelar tu acceso a Farvion, con o sin aviso previo, si encontramos indicios de que has infringido estos Términos de Servicio (incluso a través del sistema de moderación automática de la sección 7), hecho un uso indebido del servicio, o puesto en riesgo la seguridad o integridad del servicio para otros usuarios. También puedes dejar de usar Farvion y eliminar tu cuenta en cualquier momento desde el menú de Cuenta. Las secciones 8 (Contenido que envías), 9 (Generación y edición de imágenes), 10 (Propiedad intelectual), 11 (Limitaciones de responsabilidad de la IA), 13 (Limitación de responsabilidad) y 15 (Ley aplicable) seguirán vigentes tras la cancelación o eliminación de tu cuenta.

13. Cambios y disponibilidad del servicio

Debido a que Farvion aún está en desarrollo, podemos añadir, modificar o discontinuar ciertas funciones, experimentar tiempo de inactividad, o actualizar estos Términos de Servicio de vez en cuando. Intentaremos notificarte sobre cambios importantes, pero no garantizamos aviso para cada cambio menor durante el período de desarrollo. Tampoco somos responsables de retrasos o fallos en la prestación del servicio causados por circunstancias razonablemente fuera de nuestro control (fuerza mayor), incluyendo, entre otros, interrupciones en proveedores de infraestructura de terceros, desastres naturales o fallos en la red de internet.

14. Limitación de responsabilidad e indemnización

En la medida permitida por la ley aplicable, Farvion se ofrece "tal cual" sin garantías de ningún tipo. No somos responsables de pérdidas indirectas, pérdida de datos u otros daños derivados del uso de este servicio. Aceptas eximirnos de responsabilidad frente a cualquier reclamación de terceros derivada de tu infracción de estos Términos de Servicio o del uso indebido del servicio por tu parte.

15. Ley aplicable y resolución de disputas

Estos Términos de Servicio se rigen e interpretan de acuerdo con las leyes de la República de Indonesia, sin tener en cuenta los principios de conflicto de leyes. Cualquier disputa que surja de estos Términos de Servicio o esté relacionada con ellos se intentará resolver primero de manera amistosa entre tú y nosotros. Si la resolución amistosa no tiene éxito, la disputa se resolverá ante los tribunales competentes en Indonesia, salvo que la ley aplicable disponga lo contrario.

16. Disposiciones varias

Si un tribunal competente determina que alguna disposición de estos Términos de Servicio es inválida o inaplicable, dicha disposición se separará y no afectará la aplicabilidad de las disposiciones restantes. El hecho de que no hagamos valer algún derecho o disposición no se considerará una renuncia a dicho derecho o disposición.
